Measures you can take to GUARD YOUR GOLDMINE℠
- Add a copyright notice on your work. Add a watermark or disable “right click”
- Create a Google alert
- Create strong Terms of Service on your webpage. (Also known as Terms of Use or Terms and Conditions). For a quick overview https://en.wikipedia.org/wiki/Terms_of_service (Retrieved August 5, 2018.)
- Register your work with the U.S. Copyright Office. https://www.copyright.gov/circs/circ02.pdf
- Evaluate each case: Does Fair Use allow them to use your work? Is the infringer making money from your work or does it seem to be unintentional?
- Contact the infringer by email to inform (educate) them nicely that they have used your copyrighted work without permission. Give them options, with a deadline.
- Contact the platform that is hosting the site (e.g. WordPress) and ask that your content be removed. Each social media site also has a copyright infringement section with instructions to request removal.
- Do a WHOIS or DNS search to find the host registrar and file a DMCA takedown notice. Attorney Carolyn E. Wright provides a helpful discussion of the steps. Carolyn E. Wright. [File a DMCA] https://nppa.org/page/5617 (Retrieved August 5, 2018.)
- Consult an attorney with appropriate expertise.
- Chalk it up to the “cost of doing business,” and return your attention to creating content. Implement GUARD YOUR GOLDMINE℠ measures outlined above
